Some of them do ask, although technically it's not legal for them to refuse to rent based on that. For whatever good that does.
Luckily what my landlady is doing is highly illegal. If I wanted to, I could force her to let me stay for the duration of my lease, because she's claiming damage that doesn't exist. Both the paralegals I talked to told me that she'd be laughed out of the Landlord and Tenant Board's court based on what she's done.
The goal now is to be as prepared as possible so that she doesn't trample all over me and my rights. I want to get out, but I don't want to leave myself open to being liable for later damages she can them claim were incurred during my tenancy. What a pain.
